2GP – Appeals
Two further rounds of mediation have been held since the last update.
Almost all appeals have now been mediated, although a small number are likely to require further mediation before resolution is reached. The Court has recently issued consent memoranda resolving appeals on matters such as management of scheduled trees in the Campus Zone, a rural residential rezoning, location of the Silverpeaks significant natural landscape overlay on a rural property, as well as a major residential rezoning in Mosgiel rezoning (see earlier article).
309 of the original 381 appeal points have now been either resolved (consent memorandum lodged with the Court) or have been withdrawn. A further 18 appeal points are close to finalisation, with consent order documentation being prepared or circulated for signing.
At present, five appeals are set down for an Environment Court hearing. These are likely to be held in September and October.
The remaining appeal points generally have a narrow impact on the plan, for example relating to a single site or small area or a rule with a relatively small impact. This means that most rules in the 2GP can be treated as operative.
